Exemption order from Victorian Animal Aid Trust from specific operation of 63A

Exemption for Victorian Animal Aid Trust from Specific Operation of Section 63A
The Governor in Council under section 5 of the Domestic Animals Act 1994 exempts the proprietors of the 'Victorian Animal Aid Trust' from the operation of section 63A of the Act in relation to compliance with section 2.3.5(d) of the Code of Practice for the Management of Dogs and Cats in Shelters and Pounds, of which the making of was published in the Government Gazette G45 on 12 November 1998 (page 2750), requiring that dogs being exercised must be confined within the shelter premises, subject to the following conditions —
(a) the exemption only applied to dogs currently identified in the Animal Rehabilitation Training program that have undergone and been assessed for temperament to the satisfaction of the proprietor of the 'Victorian Animal Aid Trust';
(b) that these dogs may only be exercised at the Lilydale-Warburton Rail Trail and within the car park area of PETstock, Lilydale at 445-449 Maroondah Highway, Lilydale, with permission of the controlling agency for these areas;
(c) that these dogs may only be exercised outside the premises of the Victoria Animal Aid Trust' on a chain, cord or leash attached to an experienced dog handler approved by the proprietor of the 'Victorian Animal Aid Trust' and that these dogs must remain under the control of that handler while in the areas mentioned in paragrah (b)
(d) no transactions for adoption may occur in the areas mentioned in paragraph (b)
This Order comes into effect from the date it is published in the Government Gazette.
