Condition 25C - Grape Phylloxera: Grape must and unfiltered juice

Definitions

  • Phylloxera Exclusion Zones (PEZ) means a part of the state that has completed a recognised surveillance program to determine the region is free of phylloxera and is identified under a control order for the purpose of preventing the entry of grape phylloxera into area and has an Area Freedom Certificate issued by the Chief Plant Health Officer of the state.
  • Phylloxera Infested Zones (PIZ) means a part of the state where phylloxera is known to be present. Restrictions are in place to prevent the spread of phylloxera from the area.
  • Phylloxera Risk Zone (PRZ) means a part of the state where Phylloxera has not been detected and has not been through a recognised surveillance program.
  • Must is defined as the total product of crushing grape berries, includes juice, skins, seeds, pulp and possibly some stems and leaves.
  • Filtered Juice means the liquid fraction of grape must that has been processed (including but not limited to filtration or centrifugation) to achieve a maximum particle size of 50 microns).
  • ICA-22 means the Interstate Certification Assurance Accreditation Procedure for the Transfer of grape must and fresh juice from a PIZ or PRZ for winemaking in a PEZ.

The movement of Must and Unfiltered Juice:

  • from an area certified as known to be free of Phylloxera to any place in Victoria; or
  • from a PEZ to any place in Victoria; or
  • from a Victorian PRZ within the PRZ or into a Victorian PIZ;

may move without restriction, otherwise the movement of must and unfiltered Juice:

  1. from a Victorian PIZ to another Victorian PIZ is prohibited unless certified:
    1. in the case of whole must, be prepared from grapes which have been de‐stemmed and crushed; and
    2. in the case of juice, be prepared from grapes which have been crushed with or without de‐stemming; and
    3. be consigned:
      1. in tankers, or other sealed containers which are
        1. cleaned free of soil and organic matter; and
        2. sealed to prevent leakage or spillage; and
      2. along a route approved by an Inspector; and
      3. with an emergency response plan, approved by an Inspector, for handling spillages.
  2. from a Victorian PIZ to any place within a PRZ or PEZ, or a Victorian PRZ to any place within a PEZ is prohibited unless certified:
    1. under a permit that:
      1. in the case of whole must be prepared from grapes which have been de‐stemmed and crushed; and
      2. in the case of juice, be prepared from grapes which have been crushed with or without de‐stemming; and
      3. be consigned:
        1. in tankers, or other sealed containers which are
          • cleaned free of soil and organic matter; and
          • sealed to prevent leakage or spillage; and
        2. along a route approved by an Inspector; and
        3. with an emergency response plan, approved by an Inspector, for handling spillages; and
      4. received by a business:
        1. accredited under ICA‐22, or
        2. inspected by an Inspector and found to have suitable systems in place for the receival of must or juice, including;
          • a dedicated unloading area;
          • signage indicating designated roadways, and no‐entry areas
          • waste disposal procedures;
          • spill control procedures; or
    2. under a Plant Health Assurance Certificate that:
      1. the grape must or unfiltered juice is consigned, transported and received in accordance with ICA‐22.
  3. from an Interstate PIZ or Interstate PRZ to any place in Victoria is prohibited unless certified that:
    1. in the case of whole must, be prepared from grapes which have been de‐stemmed and crushed; and
    2. in the case of juice, grapes have been crushed with or without de‐stemming; and
    3. be consigned:
      1. using transport vehicles or other sealed containers which have been cleaned free of soil and organic matter; and
      2. along a route approved by an Agriculture Victoria Inspector; and
      3. with an emergency response plan, approved by an Agriculture Victoria Inspector, for handling spillages; and
    4. received by a business:
      1. accredited under ICA‐22, or
      2. inspected by an Agriculture Victoria Inspector and found to have suitable systems in place for the receival of must or juice, including;
        1. a dedicated unloading area;
        2. signage indicating designated roadways, and no‐entry areas
        3. waste disposal procedures;
        4. spill control procedures.
